Terms & Conditions of Business FALIREAS PRODUCTIONS

1. Contractual Parties
Contractual Parties in the context of this Terms & Conditions of Business are FALIREAS PRODUCTIONS , owned by Annerieke Diepeveen and represented by Gregory Falireas (in the following designated as "FALIREAS PRODUCTIONS"), Amfeias 28, 11475, Athens, GREECE and the client.

2. Contractual Subject
The present Terms & Conditions of Business apply for the purchase of all products, which are offered by FALIREAS PRODUCTIONS  in the online shops under the domain www.falireas.com.

3. Conclusion of agreement
The contract will be concluded by electronic transmission (e-mail or fax) of an acknowledgement of order or by deliverance of the goods, except when otherwise stipulated.

4. Delivery
Unless otherwise agreed, ordered products will be sent by postal mail. Delivery times and shipment costs are subject to the terms and conditions of the different shippers To the extent that deadlines and due dates are specified, regardless of whether by the customer or by FALIREAS PRODUCTIONS , these will be non-binding. Except a fix delivery date is guaranteed by FALIREAS PRODUCTIONS  in writing.

5. Availability of goods
FALIREAS PRODUCTIONS  cannot guarantee that the availability details are correct in every case. Therefore FALIREAS PRODUCTIONS  reserves the right to withdraw from the contract and decline to deliver. In case an ordered item is unavailable, the Purchaser shall be informed immediately that the goods will not be delivered and any payment already supplied by the Purchaser shall be compensated without delay.

6. Warranty
In case of a product fault, FALIREAS PRODUCTIONS  might upon their own choice send a replacement product, reimburse or discount the purchase price. The Buyer has to check the product immediately after delivery and return it immediately to FALIREAS PRODUCTIONS . If the Buyer does not adhere to this procedure the goods will be considered as being approved, unless the product has a fault, which could not be detected immediately. In case of such later detected damage the fault has to be reported immediately otherwise the goods will be considered as being approved even with such fault. Any faults visible at the point of delivery have to be reported to the shipper and have to be confirmed by him.

7. Liability
a) Under no circumstances, including but not limited to negligence, shall FALIREAS PRODUCTIONS  be liable to the Purchaser for indirect, incidental, consequential, special, punitive or exemplary damages even if the Purchaser has advised the Vendor the possibility of such damages, arising from use of or inability to use any products purchased using this site - including but not limited to - loss of revenue or anticipated profits or lost business.

b) In no event shall FALIREAS PRODUCTIONS  combined total liability to the Purchaser for all damages, losses and causes of action - whether in contract or tort, including but not limited to negligence - exceed the amount paid for the products purchased using this site.

c) This exemption from liability shall not apply to damages that occur within the object of purchase itself, to damages caused deliberately or through gross negligence, to damages covered by product liability legislation and to death or personal injury. It shall also not apply if the damage results from the lack of a contractually guaranteed property.

8. Pricing
All prices are in Euro or US$ Dollar and include value added tax. For customers outside the European Union the Prices do NOT include VAT. FALIREAS PRODUCTIONS reserves the right to change prices at any time.

9. Payment
The invoice balance has to be fully paid in advance, without any deduction, except as otherwise agreed. Payments are to be considered to be fully paid, when the balance is credited to the bank account of FALIREAS PRODUCTIONS .
There are 2 payment options available:
Prepayment payment has to be done in advance to the account of FALIREAS PRODUCTIONS . The client has to bare the costs of the bank transfer.
PayPal: the client pays the fees of his bank or credit card provider FALIREAS PRODUCTIONS bares the Paypal fees. However FALIREAS PRODUCTIONS  reserves the right, to charge proportional Paypal fees from the customer.

10. Reservation of title
Until such time as the delivery/service has been paid in full, including all and any costs and interest, and until such time as all previous deliveries/services covered by the existing business relationship have been settled, the goods supplied shall remain the property of FALIREAS PRODUCTIONS .

11. Cancellation Right (for Customers of the European Union only)
a) Regardless of the warranty rights the Buyer has a special right to return goods, since you are acquiring the goods from a remote site. You can exercise your right by returning the supplied goods in an appropriate packet within two weeks after delivery to:

b) To stay within that time limit it is sufficient, if the goods have been sent off within that time limit. Should you already have used the goods, we reserve the right to charge a usage levy. You can avoid such a usage levy by preventing any traces of usage, by using the original packaging when returning the goods and if you insert all supplied accessories and documents

c) In the event of a cancellation, we will remunerate any payments already received upon receipt of the returned merchandise. You are obliged to return to us the goods - for which the risk will be borne by us - if you have not already done so when sending us your letter of cancellation. You will be responsible for bearing the costs of returning the goods.

12. Validity of the provisions of the contract
Should any one of the terms of these terms and conditions of business prove to be invalid or become invalid at a later date, this shall not affect the validity of the rest of this contract. In this case, the invalid term shall be replaced with a term that most faithfully represents its economic intention and purpose or the appropriate legal provisions.

13. Applicable Laws
For any contractual relations with FALIREAS PRODUCTIONS apply the Laws of Greece.
In business transactions with merchants and legal persons under public law, the place of jurisdiction shall be Athens, Greece
